Paynter & Williams Pty Ltd

1. Agreement Overview

This Terms of Service agreement is made between Paynter & Williams Pty Ltd (ABN 95 667 041 241), either acting independently or through its photographers, and the Client, their representatives, vendors, or developers commissioning a Photography Shoot/Floor Plan booking. All parties involved are subject to the following legal and copyright terms.

2. Booking & Acceptance

By booking a Photography Shoot/Floor Plan with Paynter & Williams Pty Ltd, either verbally or in writing, the Client confirms they have read, understood, and agreed to these Terms of Service. Bookings are confirmed before the appointment, and once scheduled, Paynter & Williams Pty Ltd will not accept other bookings for that time. It is the Client’s responsibility to inform vendors or tenants of the appointment details. Cancellations or lack of access to the property may incur fees as outlined below.

3. Cancellation Policy

• More than 48 hours before appointment: No cancellation fee.
• 24 to 48 hours before appointment: 50% cancellation fee.
• Less than 1 hour before appointment or no access to property: 100% cancellation fee.
  Rescheduled appointments are treated as new bookings.

4. Intellectual Property & Copyright

All images and creative media remain the intellectual property of the Photographer and Paynter & Williams Pty Ltd, protected under Australian and international copyright laws.

5. Licensing

• Clients (Realestate Agents & Representatives): A non-exclusive, non-transferable, worldwide license is granted for direct marketing of the property sale for the duration of the listing. If the Client enters receivership or liquidation, the license is revoked.
• Vendors: Granted a non-exclusive personal-use license. Images cannot be resold, relicensed, or used for advertising.
• Photographer’s Rights: Paynter & Williams Pty Ltd retains all copyrights, ownership, and licensing rights.

6. Relicensing

Paynter & Williams Pty Ltd reserves the right to relicense imagery to third parties, including real estate agents or advertising agencies, once the original advertising campaign has ended. Clients will be notified whenever possible, and relicensing fees will apply.

7. Promotional Use

Paynter & Williams Pty Ltd retains the right to use all images for self-promotion, including advertising, website galleries, and social media.

8. Pricing & Travel Fees

• Prices and packages are subject to change.
• Travel within Brisbane City Region, Redland City Region & Moreton Bay Region is included. A surcharge may apply for locations outside of the above.

9. Property Preparation

Clients should ensure the property is decluttered before the shoot. The photographer may make minor adjustments for optimal results but is not responsible for significant rearrangements. Excessive clutter may result in fewer images being supplied.

10. Weather Conditions

• Shoots may proceed if weather conditions are deemed suitable.
• In severe weather, bookings may be rescheduled at no extra charge.

11. Aerial Photography & Videography

• Paynter & Williams Pty Ltd offers aerial photography services where legally permissible. However, drone operations are subject to Civil Aviation Safety Authority (CASA) regulations and local airspace restrictions.
• In no-fly zones or areas where drone use is prohibited, we offer alternative solutions such as high-resolution Google Earth imagery or other aerial mapping services.
• Clients should verify any location restrictions before booking, and Paynter & Williams Pty Ltd reserves the right to decline drone photography where flight permissions cannot be obtained.

12. Delivery of Media

• Images and Floor Plans are typically delivered by midday the next business day.
• Property Videos are typically delivered by close of business the next business day.
• Property films are typically delivered by close of business two days after the booking.
• Clients will receive an email notification once files are ready for download.

13. Revisions & Reshoots

• Clients may request reasonable amendments at no extra charge.
• If no representative is present at the shoot, the Photographer’s interpretation is final.
• Reshoots due to property changes (e.g., new paint, furniture rearrangement) may incur additional fees.

14. Floor Plan Measurements

• Measurements are taken from ‘inside wall’ to ‘inside wall’ and are for marketing purposes only.
• Accuracy is not guaranteed, and clients must verify details before publication.

15. Technical & Marketing Support

Clients should inform Paynter & Williams Pty Ltd of any specific marketing requirements for image adaptation.

16. Payment & Late Fees

• Payments are due within 7 days of the invoice date, unless other terms are agreed upon.
• Late payments incur a 5% recurring daily late fee.
• Services may be suspended until outstanding payments are settled.

17. Governing Law

This agreement is governed by the laws of Queensland, Australia. Paynter & Williams Pty Ltd’s intellectual property is protected internationally under copyright treaties.

18. Updates to Terms of Service

These Terms of Service may be updated at any time. The latest version is available at https://paynterwilliams.co/terms-of-service and supersedes all previous versions.
